Across the United States, local governments have millions of dollars in delinquent property taxes which are owed by property owners who will not or cannot pay their property taxes.

Unpaid real estate taxes creates a serious cash-flow problem for communities. If local governments are unable to collect real estate property taxes, they are also unable to fund important government services.

 

To Recover Lost Tax Revenue, Local Communities Create and Sell Tax Lien Certificates

To fund public services cash-strapped governments sell these tax debts (known as tax lien certificates) to people like you or me. The tax lien is secured by the real estate that it is attached to. The purchaser isn't buying the property rather the governments right to receive taxes and interest on the real estate.

When you purchase a tax lien certificate, you are paying the delinquent property tax bill for someone else. The sale of the tax lien certificate transfers to you the right to receive the property taxes due, PLUS high interest and penalties.

The sale of tax lien certificates solves several problems; communities get their much needed tax dollars, allowing them to fund public services, property owners get more time to pay their delinquent taxes (this period of time is called the redemption period) and purchasers get tax lien certificates which include penalty / interest rates of 16%, 18%, 24%, up to 36% mandated by state law.

When the property owner pays the delinquent taxes (usually within 2 years) the government will mail the purchaser a check covering what was paid to satisfy the back taxes PLUS penalty interest rates of 16%, 18%, 24%, up to 36%!

 

Real Estate Tax Liens are Senior to Other Liens Including Mortgages and Deeds of Trust.

If the property owner does not satisfy the delinquent taxes within the period of time specified by state law (known as the redemption period), then state law authorizes the local government with the authority to execute a deed for the property to the purchaser of the tax lien.

For example, in the state of Florida:

"All taxes imposed pursuant to the State Constitution and laws of this state shall be a first lien, superior to all other liens, on any property against which the taxes have been assessed..."

(2016 Florida Revised Statutes (Title 14 Ch. 197 Sec. 122)

Just like Florida, throughout the United States, legislatures have passed laws which make the real estate tax lien superior and senior to all other liens and encumbrances, including mortgages and deeds of trust.

 

With tax lien certificates either get the past-due taxes plus interest or you get the property - no mortgage!

In review, when you purchase a tax lien certificate, you are paying the delinquent property tax bill for someone else. The sale of the tax lien certificate transfers to you the right to receive all the property taxes due, PLUS high interest and penalties.

When the property owner pays the delinquent property taxes (usually within 2 years) the government will mail you a check covering what was paid to satisfy the back taxes PLUS law-mandated penalty interest rates of 16%, 18%, 24%, up to 36%!

If the property owner does not satisfy the delinquent taxes within the period of time specified by state law (known as the redemption period), then the county has the legal right to give you the property - no mortgage!
